Welcome to TradeNote (the "Service"), operated by Eleven Trading ("we," "our," or "us"). By using the Service, you agree to comply with and be bound by these Terms of Use (the "Terms"). If you do not agree to these Terms, do not use the Service.
1. Description of Service
TradeNote provides an open source trading journal, also available as cloud hosted on a subscription basis. The Service is billed monthly and can be canceled at any time as outlined below.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of entering into a legally binding agreement to use the Service.
3. Accounts
a. Account Registration
To access the Service, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
b. Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in any activity that may harm the Service or its users.
4. Subscription and Payment
a. Billing
The Service is provided on a monthly subscription basis. Payments are due at the start of each billing cycle. By subscribing, you authorize us to charge your payment method for the subscription fee.
b. Cancellation
You may cancel your subscription at any time by sending an email to hello@eleven.trading. However, we do not provide prorated refunds. Your cancellation will take effect at the end of the current billing cycle, and you will retain access to the Service until the cycle concludes.
c. Changes to Pricing
We reserve the right to change subscription fees with 30 days' prior notice. Continued use of the Service after the notice period constitutes acceptance of the new pricing.
5. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or to violate any applicable law.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
We reserve the right to investigate and take appropriate legal action against users who violate this section.
6. Intellectual Property
All content, trademarks, logos, and software associated with the Service are owned by or licensed to Eleven Trading. You are granted a limited, non-exclusive, and non-transferable right to use the Service for personal or business purposes, as applicable.
7. Termination of Service
We reserve the right to suspend, restrict, or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if we discontinue the Service.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the fullest extent permitted by law, Eleven Trading shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising under these Terms shall not exceed the amount paid by you for the Service during the previous 12 months.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of EU, without regard to its conflict of law principles.
11. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice on the Service. Continued use of the Service after such changes constitutes your acceptance of the updated Terms.
